By placing an order with us, you accept these Terms and Conditions in full.

Section 2: Description of Service

We offer personalised AI-illustrated hardcover storybooks based on photographs and biographical information that you provide. Our service includes:

Each book is unique and one-of-a-kind. The Memolio product is hardcover-only — we do not currently sell a stand-alone digital PDF.

Section 3: Ordering Process

3.1 How to Order

Complete the questionnaire, upload photographs, review your order, and confirm submission.

3.2 Contract Formation

A binding contract is formed upon your order submission. We will send you a confirmation email.

3.3 Delivery Timeframe

Printing and physical fulfilment are carried out by our print partner CloudPrinter B.V. (Maliebaan 50, 3581 CS Utrecht, Netherlands) and their European production partners. Delivery is currently available within the EU and the United Kingdom.

3.4 Right to Refuse Orders

We reserve the right to refuse orders containing inappropriate, offensive, or illegal content.

Section 5: Right of Withdrawal — Important Notice

5.1 Exclusion for Personalised Goods

The 14-day withdrawal right under the Austrian Fern- und Auswirkungsgesetz (FAGG) § 11 does NOT apply to personalised goods. Your book is one-of-a-kind and specifically created for you.

Legal basis: FAGG § 18 Abs. 1 Z 3 and EU Consumer Rights Directive 2011/83/EU Article 16(c).

5.2 Your Explicit Consent to Immediate Production

IMPORTANT — Please read carefully:

By confirming your order, you explicitly acknowledge and agree that:

  • The product is personalised and one-of-a-kind, manufactured to your individual specifications
  • AI generation of your book begins immediately upon order confirmation, and printing begins immediately upon your final approval of the preview
  • You lose your statutory 14-day withdrawal right under FAGG § 18 Abs. 1 Z 3 because the goods are personalised

This waiver applies only to the statutory 14-day withdrawal right for personalised goods. Your statutory warranty rights for defects (Section 11) are not affected.

Section 7: AI Disclosure

7.1 Fully AI-Generated Content

All text and illustrations are generated by artificial intelligence. No human author or illustrator is involved in the creation of your book's content.

7.2 Potential Imperfections

AI-generated content may contain minor imperfections, inconsistencies, or unusual phrasing. This is inherent to the technology and is not grounds for refund or cancellation.

This disclosure is made in accordance with the EU AI Act (Regulation (EU) 2024/1689), Article 50 (transparency requirements for AI systems).

Section 8: Intellectual Property

8.1 Copyright Considerations

AI-generated content may not be eligible for copyright protection in all jurisdictions. We make no representations regarding copyright ownership.

8.2 License to You

You receive a perpetual, non-exclusive, non-transferable licence to use your personalised book for personal, non-commercial purposes.

8.3 Restrictions

You may not:

We may use anonymised excerpts from your book (without personal information or identifying details) for marketing or promotional purposes unless you opt out in writing.

Section 9: Limitation of Liability

To the extent permitted by Austrian law, our liability is limited to:

Mandatory consumer protection laws remain unaffected. If you are a consumer under Austrian law (ABGB), your statutory rights cannot be limited.

Section 10: Data Protection

Your personal data is processed in accordance with our Privacy Policy. Please read it carefully.

Section 11: Complaints and Warranty

If you have complaints about your order, please contact us at hello@memolio.io as soon as you spot the issue, and ideally within 14 days of delivery so we can investigate any transit damage with the carrier.

Your statutory warranty rights under the Austrian ABGB (§§ 922 ff) remain unaffected and apply as normal for the physical hardcover. If a book arrives damaged, misprinted, or otherwise defective through no fault of your own, we will reprint and reship the book at our expense.

Section 12: Governing Law and Jurisdiction

These Terms & Conditions are governed by Austrian law, excluding conflict of law rules and the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers, the jurisdiction of your domicile is preserved as required by law.

Section 13: Online Dispute Resolution

Consumers in the European Union may use the European Commission's Online Dispute Resolution platform:

Section 14: Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in force.

Section 15: Changes to These Terms

We may update these Terms & Conditions at any time. Changes will be effective immediately upon posting to this page. Your continued use of our service constitutes acceptance of any changes.
